Seminar Finding The Law - A Junior Lawyer's Guide To Challenging Enforcement Officer Evidence

FINDING THE LAW –

A JUNIOR LAWYER'S GUIDE TO CHALLENGING ENFORCEMENT OFFICER EVIDENCE

Dear Members and Pupils,

In criminal litigation, the prosecution's case often hinges heavily on the testimony of arresting and investigating officers. For defense counsel, the ability to effectively challenge and dismantle this evidence during cross-examination is a critical skill.

We are pleased to invite you to a highly engaging dialogue session designed to elevate your oral advocacy skills. Unlike a traditional lecture, this event will be structured as a dynamic conversation, allowing for deep dives into tactical courtroom strategies.

About the Speaker & Format

The dialogue will feature Tuan Mohd Haijan Bin Omar, a formidable practitioner in criminal defense and appellate litigation, guided by our moderator, Tuan Mohd Fazaly Ali Bin Mohd Ghazaly. Young lawyers will gain frontline insights from a counsel who has actively litigated and tested evidence in some of the nation's most closely watched, high-profile criminal cases, including:

  1. Public Prosecutor v Syed Saddiq bin Syed Abdul Rahman [2025] 7 MLJ 828
  2. Pendakwa Raya lwn Muhammad Arif Firdaus bin Juraini dan satu lagi rayuan [2023] 6 MLJ 277

  2. Control the Witness: Adopt effective questioning techniques that corner evasive or overly confident enforcement officers.
  3. Anticipate the Bench: Understand what magistrates and judges look for when assessing the credibility of an enforcement officer's testimony.
  4. Avoid Common Pitfalls: Identify and eliminate the frequent cross-examination mistakes that inadvertently strengthen the prosecution's case.
